Artikel 64
Verdrag van Ljubljana-Den Haag inzake internationale samenwerking bij de opsporing en vervolging van genocide, misdrijven tegen de menselijkheid, oorlogsmisdrijven en andere internationale misdrijven
1. The requested State Party shall, insofar as its domestic law permits and at the request of the requesting State Party, seize and hand over property:
a) Which may be required as evidence; or
b) Which being the results of the crime and which, at the time of the arrest, is found in the possession of the person sought or is discovered subsequently.
2. The property referred to in paragraph 1 may be handed over to the requesting State Party even if extradition, having been granted, cannot be carried out owing to the death, disappearance or escape of the person sought.
3. When the property referred to in paragraph 1 is subject to seizure or confiscation in the territory of the requested State Party, that State Party may, in connection with pending criminal proceedings, temporarily retain it or hand it over to the requesting State Party on the condition that it is returned.
4. Any rights which the requested State Party or third parties acting in good faith may have acquired in the property referred to in paragraph 1 shall be preserved, in accordance with the procedures provided for by its domestic law. Where these rights exist, the requesting State Party shall return such property to the requested State Party as soon as possible and without charge at the end of the proceedings.
