Artikel 61
Verdrag van Ljubljana-Den Haag inzake internationale samenwerking bij de opsporing en vervolging van genocide, misdrijven tegen de menselijkheid, oorlogsmisdrijven en andere internationale misdrijven
1. If the request is agreed to, the requesting State Party and the requested State Party shall consult and agree on the place and date of surrender. The requesting State Party shall be informed of the length of time the person sought was detained with a view to the surrender.
2. Subject to paragraph 3, if the person sought has not been taken over on the appointed date, the person may be released after the expiry of 30 days and shall in any case be released after the expiry of 45 days, unless otherwise specified by the requested State Party. The requested State Party may refuse to extradite the person for the same crime.
3. If circumstances beyond its control prevent a State Party from surrendering or taking over the person to be extradited, it shall notify the other State Party. The States Parties concerned shall consult and may agree on a new date for surrender and the provisions of paragraph 2 shall apply.
