Artikel 43

1. Persons detained by the Kosovo Relocated Specialist Judicial Institution in the Host State shall not be released in the Host State, except for persons who are nationals or permanent residents of the Host State. The Kosovo Relocated Specialist Judicial Institution retains jurisdiction over such persons until their return and release in the country where they were originally detained on behalf of the Kosovo Relocated Specialist Judicial Institution or in Kosovo, or if they do not have rights of residency in either of those places, in a country where they are ordinarily and/or lawfully resident, or in another country which agrees to receive them, in accordance with Article 41(11) of Law No. 05/L-053. The Kosovo Relocated Specialist Judicial Institution bears the responsibility for the departure of such persons from the Host State.
2. The Kosovo Relocated Specialist Judicial Institution shall make such arrangements [as it considers appropriate] for the transfer of the person to one of the countries referred to in paragraph 1 of this Article.
3. The provisions of Article 40 of this Agreement shall apply, mutatis mutandis, to the transport of persons referred to in this Article within the Host State.
4. The Government of Kosovo shall take all necessary measures to protect the safety and well-being of a person referred to in this Article when he or she is released in Kosovo.
