Artikel 46

Europees Verdrag inzake de internationale geldigheid van strafvonnissen

1. When the request for enforcement concerns the confiscation of a specific object, the court or the authority empowered under Article 37 may order the confiscation of that object only insofar as such confiscation is authorised by the law of the requested State for the same offence.
2. However, the court or the authority empowered under Article 37 may maintain the confiscation ordered in the requesting State when this sanction is not provided for in the law of the requested State for the same offence but this law allows for the imposition of more severe sanctions.
