Overeenkomst tussen de Benelux-Staten en de Kirgizische Republiek inzake de vrijstelling van de visumplicht voor houders van geldige diplomatieke paspoorten en officiële/dienstpaspoorten

In this Agreement, unless the context indicates otherwise:
1. “Benelux States” shall mean the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands;
2. “Party” shall mean the Kyrgyz Republic or the three Benelux States acting jointly: the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands;
3. “State” shall mean the Kyrgyz Republic or one of the Benelux States;
4. “Territory” shall mean: – For the Kyrgyz Republic: the territory of the Kyrgyz Republic;
– For the Benelux States: the territories in Europe of the Benelux States.
– For the Kyrgyz Republic: the territory of the Kyrgyz Republic;
– For the Benelux States: the territories in Europe of the Benelux States.

The Competent Authorities responsible for the implementation of this Agreement shall be:
a. for the Kyrgyz Republic: the Ministry of Foreign Affairs;
b. for the Kingdom of Belgium: the Federal Public Service Foreign Affairs, Foreign Trade and Development Cooperation;
c. for the Grand Duchy of Luxembourg: the Ministry of Foreign and European Affairs, Defence, Development Cooperation and Foreign Trade; and
d. for the Kingdom of the Netherlands: the Ministry of Foreign Affairs.

1. A national of the Kyrgyz Republic who is a holder of a valid diplomatic or service/official passport may enter the territories of the Benelux States without a visa and stay in these territories for a period not exceeding ninety (90) days in any period of one hundred and eighty (180) days.
2. A national of a Benelux State who is a holder of a valid diplomatic or service/official passport may enter the territory of the Kyrgyz Republic without a visa and stay for a period not exceeding ninety (90) days in any period of one hundred and eighty (180) days.

1. A national of the Kyrgyz Republic who is appointed at a diplomatic mission or consular post or a mission to an international organisation located in the territory of a Benelux State bearing a valid diplomatic or service/official passport and has been assigned with the authorities of the receiving Benelux State may enter, depart from and stay in the territory of that Benelux State without a visa for the duration of his or her accreditation/assignation.
2. A national of a Benelux State who is appointed at a diplomatic mission or consular post or a mission to an international organisation located in the territory of the Kyrgyz Republic bearing a valid diplomatic or service/official passport and has been assigned with the competent authority of the Kyrgyz Republic may enter, depart from and stay in the territory of the Kyrgyz Republic without a visa for the duration of his or her accreditation/assignation.
3. The sending State shall notify the receiving State of the arrival of the members of diplomatic missions or consular posts or missions to international organisations mentioned in paragraph 1 or 2 of this Article, and they shall comply with the accreditation and assignation regulations of the receiving State.

Notwithstanding Articles 3 and 4 of this Agreement, each State reserves the right to refuse to admit to its territory any person who is regarded as being undesirable or whose presence in the country is regarded as prejudicial to public order or to national security.

1. This Agreement shall be without prejudice to the rights, obligations and responsibilities of the Parties arising from other international agreements.
2. Except as herein provided, this Agreement shall not affect the laws and regulations in force in the States governing entry, length of stay, residence, professional occupation and expulsion of foreigners.

1. Upon request, the Kyrgyz Republic undertakes to readmit to its territory, at any time and without formalities, persons who have entered the territory of a Benelux State on a valid national diplomatic or service/official passport issued by the authorities of the Kyrgyz Republic.
2. Upon request, a Benelux State undertakes to readmit to its territory, at any time and without formalities, persons who have entered the territory of the Kyrgyz Republic on a valid diplomatic or service/official passport issued by the authorities of the requested Benelux State.

The Kyrgyz Republic and the Benelux States shall provide each other through diplomatic channels with specimens of their new or modified diplomatic or service passports, as well as with the particulars concerning the use of these passports, as far as possible, sixty (60) days before their date of introduction.

Any dispute between the Parties arising from the application or interpretation of this Agreement shall be settled amicably through consultations or negotiations between the Parties.

1. The General Secretariat of the Benelux Union shall be the depositary of this Agreement.
2. The depositary shall provide all Signatory States with a certified copy of the original of this Agreement.

1. This Agreement may be amended and supplemented by mutual consent of the Parties. Amendments and supplements which shall form an integral part of this Agreement shall be drawn up in the form of separate protocols.
2. These amendments and supplements shall enter into force in accordance with the procedure laid down in Article 12, paragraph 1.
3. The Parties shall inform the depositary thereof.

1. All Signatory States shall notify the depositary of the completion of their internal procedures for the entry into force of this Agreement. This Agreement shall enter into force on the first day of the second month following the date of receipt by the depositary of the last of these notifications.
2. Notwithstanding paragraph 1, should the last notification be deposited before the deposit of the last notification by the Signatory State on the completion of internal formalities required for entry into force of the Agreement between the Benelux States and the Kyrgyz Republic on the readmission of persons having entered and/or residing without authorisation, this Agreement shall not enter into force until the date of the last notification by the Signatory State submitted to the depositary on the aforementioned agreement.
3. This Agreement will not be applied until the date of the entry into force of the Agreement between the Benelux States and the Kyrgyz Republic on the readmission of persons having entered and/or residing without authorisation.
4. After the entry into force of this Agreement, each Party may denounce this Agreement by sending a written notification, through diplomatic channels, of its intention to denounce this Agreement to the depositary not later than thirty (30) days prior to the date on which the denunciation is to take effect.
5. The depositary shall inform all States of the receipt of any notification referred to in this Article.

Each Party may suspend the application of this Agreement. The depositary shall be notified immediately of the suspension. The depositary shall inform the other Party of the receipt of such notification. This Agreement shall be suspended on the first day of the first month following the month in which the notification is received. The same procedure shall be adopted when the suspension is lifted.

1. The Kingdom of the Netherlands may extend the application of this Agreement to Aruba, Curaçao, Sint Maarten and the Caribbean part of the Netherlands (the islands of Bonaire, Sint Eustatius and Saba) by notifying the depositary to that effect.
2. The depositary shall inform all States of this extension.
